Job Description
Division Director - Justice

The Utah Attorney General's Office (AGO) is seeking applicants for the position of Director of the Justice Division. The Justice Division is the largest criminal prosecution division in the AGO, with five sections. Those sections include: Special Prosecutions, SECURE, ICAC, CDIU, and Victim's Services. The Justice Division works in tandem with the Investigations Division, along with other law enforcement partners throughout the state. Experience in criminal prosecution is mandatory and previous leadership experience is preferred. Applicants must possess excellent written and oral advocacy skills.

The Justice Division Director assigns cases, reviews work product - both oral advocacy skills and written submissions, provides feedback to division members as needed, reviews and makes decisions regarding division member requests for travel, training, annual and sick leave and provides mentoring and guidance to division members to ensure high quality legal work, handles basic personnel issues in consultation with the criminal deputy, and conducts semi-annual performance evaluations with division members. This position will report directly to the criminal deputy. The Division Director also handles a case load as needed, represents the Office and division as needed in legislative committee hearings, and makes presentations on criminal prosecution and other related subjects as directed by the Attorney General and the criminal deputy.

Responsibilities

  • Leads the Justice Division, including 5 different sections (Special Prosecutions, SECURE, ICAC, CDIU, and Victim's Services).
  • Prepares cases by conducting legal research and gathering evidence.
  • Provides consultation, makes recommendations, gives appropriate advice, and/or facilitates decisions.
  • Determine needs in discovery, and/or completes discovery; participates in decision making and strategy sessions in preparing cases for court and determining evidence to be used.
  • Writes or drafts correspondence, reports, documents and/or other written materials.
  • Receives, researches and responds to incoming questions or complaints; provides information, explains policy and procedures, and/or facilitates a resolution.
  • Drafts litigation working documents; prepares documents consisting of concise decisions based upon facts of case interpretations of law and compliance with state and federal standards.
  • Conduct conferences with defendants and/or attorneys and negotiate settlements.
  • Represents clients at formal or informal hearings.
  • May be required to travel to various locations and stay overnight.
  • Administrative/personnel, including budgetary issues and management of prosecutors and support staff.
  • Provides state and federal statutory interpretation.
  • Records access - GRAMA, subpoenas, court orders.
  • Handles and manages those handling high-profile and complex cases, including media
  • Multiple statewide and local committees that meet regularly, (and subcommittees)
  • Trains attorneys in all aspects of litigation practice.
  • Acts as a sounding board and resource for attorneys as they evaluate, prepare, and try cases. Conducts formal evaluations of attorneys and staff.

Supplemental Information

  • A Juris Doctorate is required.
  • Must be an active member in good standing in the Utah State Bar.
  • At least 15 years of experience in litigation is required. At least 8-10 years of criminal prosecution experience is preferred.
  • Leadership of other attorneys and staff is preferred.
  • Risks found in the typical office setting, which is adequately lighted, heated and ventilated, e.g., safe use of office equipment, avoiding trips and falls, observing fire regulations, etc.
  • Typically, the employee may sit comfortably to perform the work; however, there may be some walking; standing; bending; carrying light items; driving an automobile, etc. Special physical demands are not required to perform the work.
  • A conditional offer of employment will be made pending a satisfactory completion of a background investigation.
  • Must be able to travel as required.
  • Valid driver license required to drive a motor vehicle on a highway in this state per UCA 53-3-202(1)(a).
  • Base salary is calculated based on initial Bar admittance year, less any years not practicing law, as outlined below.
