Job Responsibilities

The Department of Children's Advocacy's General Counsel is a senior level management position with direct access to the State Child Advocate. The General Counsel serves as the primary attorney for the agency and is authorized by the Attorney General to regularly undertake and manage litigation for the agency. The General Counsel will provide legal support for a broad range of policy, procedure, and law. It will be necessary for the General Counsel to have confidence and competency to make decisions and to assist staff and constituents. Although the General Counsel is expected to be knowledgeable, to be a fast learner and to work independently, there will be continuous need to review current law and become familiar with new laws and policies as they are developed. It will be necessary for the General Counsel to regularly confer with the State Child Advocate to keep the State Child Advocate informed of complaints, concerns, and recommendations for systemic reform efforts or other action. The General Counsel should have a collaborative and teamwork attitude regarding interaction with the State Child Advocate and other members of the Department of Children's Advocacy team. In this position specific job functions include but are not limited to the following:
Minimum and Additional Requirements
A Juris Doctorate degree or its equivalent from an accredited law school and ten (10) or more years' experience with child welfare, juvenile justice and/or healthcare law. Must be admitted to SC Bar and be a member in good standing.

- Supervises staff to include preparing performance planning and evaluation documents and related personnel paperwork. Coaches, counsels and trains employees. Establishes and monitors work processes. Implements management policies and initiatives and promotes teamwork.
- Provide legal advice and support for the System Improvement Division through the Division Director regarding the delivery of services to children by Department of Disabilities and Special Needs, Department of Public Health, Department of Health and Human Services, Department of Juvenile Justice, Department of Mental Health, Department of Social Services, John de la Howe, School of the Deaf and Blind, and Wil Lou Gray Opportunity School.
- Review, monitor, confer with outside counsel, and/or respond to agency litigation and FOIA requests.
- Provide legal advice, training, management and supervision for the agency; review and respond to legislation and legislative requests pertaining to the agency.
- Educate the public regarding the role of DCA and other agencies' services and work alongside the State Child Advocate to make recommendations regarding systemic improvement for children's services by state agencies.
- Performs other related duties as required or directed.
