The Director Claim Management is responsible for overall project leadership of Claims activities and direct oversight of Claims Management team members. This comprises of leading claims strategy and execution including the engagement of external claims and legal consultants, overseeing the development of required claim document submissions, providing evaluation of claims impacts (for and against), ensuring budgetary controls for claims activities and ensuring the effective communication with legal, operational and regional leadership. This project position reports directly to the Senior Commercial Director & Prime Contracts Management with accountability to the Project Director and Regional Business Unit (RBU-US) Claim Management leadership.

The purpose of this position is to manage and lead the claims management job duties and functions as listed below with the overall objective of managing, coordinating, and implementing the project claims strategy and execution plan; establishing an execution framework that ensures compliance with contract terms, strategically protects and positions Exyte commercial success, and provides team members with the skills, tools, and support required to deliver best-in-class program/project lifecycle commercial results.

  • Directs, develops, and implements Client claims and risk mitigation strategies in partnership with Exyte project, regional and corporate stakeholders.
  • Oversee the end-to-end claims process, ensuring timely and effective resolution while minimizing financial impact.
  • Authors and/or reviews project claims correspondence to ensure Exyte's rights are protected and that it is consistent with the terms of the prime contract.
  • Provides direct oversight of the project Claim Management team including supporting technical staff involved with claims activities.
  • Follows and supports project Supply Chain procedures to close out processes; including the development of contract and claims avoidance strategies, bid and contract documents, evaluation, award, settlement of disputes and disagreements; and manages the negotiation of final claims amounts with Owner.
  • Collaborates with the Legal and Risk Management departments to obtain and provide information regarding claims issues during all phases of formation and execution of project prime contract(s), as well as work closely with Commercial Project Management and Project Controls on commercial data analysis.
  • Performs the impact assessments for change events in support of developing claims submissions to Customer or third parties. This includes schedule and cost related inputs.
  • Evaluates claims received from supply chain members including the development of positions for potential recovery from Customer.
  • Directs the gathering of data necessary for the support of written claims submissions.
  • Authors and/or contributes to the production of written claims submissions and other general related project correspondence.
  • Leads and develops strategic case management required for formal claims submissions, working with internal and external legal counsel to determine legal protocol timelines/deadlines, need for engagement of external consultants and experts, need for internal witness interviews/depositions and the review, analysis and repository of written data and information required to support claims submissions.
  • Collaborates with the Legal and Risk Management departments to obtain and provide information regarding claims issues during all phases of formation and execution of project prime contract(s), as well as work closely with Commercial Project Management and Project Controls on commercial data analysis.


Show your expertise

Minimum Required
  • Construction industry experience with relevant bachelor's degree and/or professional training required
  • 20+ years' experience in the commercial construction industry, with 15+ years of prime contracts management, claims management, commercial management, legal, procurement & subcontracts, project controls experience preferred
  • Expert experience in commercial project management, claims management, prime contracts management, legal, procurement & subcontracts, project controls, project financial management & reporting
  • Expert experience working with engineering, procurement, and construction/construction management contractors on under varying contracting models and projects of varying size (including 'mega-project' large CapEx programs)
  • Requires a comprehensive knowledge of industry business practices and management of contracts and subcontracts.
  • Requires comprehensive knowledge and experience of construction claims processes, including those in formal legal proceedings.
  • Understanding and experience with multinational business environments
  • Experience in pricing, contracts law, contract drafting, administration and negotiation of change orders, risk identification and mitigation, planning, and scheduling
  • Proficiency in the formation and administration of prime contracts and subcontracts through the several steps of bidder pre-qualification, compilation of bid requests, receipt of bids, bid evaluation, award, monitoring the performance of contractors, back charge procedures, resolution of claims and disputes, and other such related steps

Preferred
  • Experience in construction industry; specific to semiconductor plants, clean rooms and tool installs; design and/or construction of process or clean utility systems
  • Master's degree and/or advanced certification in related field(s) preferred
