This position would require a hybrid work schedule of 3 days per week onsite and 2 days remote out of our Brentwood, TN office location.
SUMMARY:
The Director, Ethics & Compliance participates in the implementation and administration of the company's organization-wide ethics and compliance program. Manages the corporate "Ethics Line" ethics and compliance and "Resident Concern Line" reporting, case triage and case management systems. Develops appropriate metrics for the ethics and compliance program and prepares reports and analyses for senior management. Assists with ethics and compliance risk management and internal controls development and manages compliance processes. Effectively models and communicates the importance of ethical conduct to all levels of the organization.
ESSENTIAL FUNCTIONS:
The incumbent should be able to perform all of the following functions at a pace and level of performance consistent with the job performance requirements.
1. Participates in corporate-level, cross-disciplinary ethics and compliance committee to ensure appropriate triage and resolution of reports received through the company's systems for reporting ethics and compliance-related concerns and allegations of misconduct.
2. Analyzes and exercises independent judgment in evaluating reports potentially raising a range of regulatory and legal compliance, ethics, human rights, operational, and human resources issues to ensure proper handling and sound disposition by the company.
3. Manages the flow of report information to resolution and ensures that all employees, contractors, customers or vendor's allegations of unethical or illegal activity are referred to the appropriate resources within the company.
4. Conducts interviews, corresponds with ethics and compliance reporters and conducts review and investigative activities as needed to determine appropriate referral or disposition by ethics and compliance.
5. Manages ethics and compliance case management system. Tracks and maintains progress on reports, maintains accurate records of case progress and resolution and summarizes activities for review by coordinating committee, appropriate senior managers and internal and external audit.
6. Maintains a functional knowledge of relevant laws and regulations, contractual requirements, policies and procedures, codes of conduct and internal and relevant external issue-resolution processes. Conducts research and prepares reports on the foregoing.
7. Maintains a holistic view of ethics and compliance risk with regard to assigned facility operational units or divisions.
8. Develops and maintains relationships with leadership of assigned facility operational units or divisions and employees from all departments and third parties, including legal, quality assurance, human resources, operations, finance, internal and external audit, vendors and consultants, and at all levels of the company, from line staff to senior management, to achieve program goals.
9. Develops appropriate data analytic strategies and metrics for the ethics and compliance program and produces reports and analyses for senior management. Collaborates with other departments to gather and validate data for analytics and reporting.
10. Recommends and implements policy and process improvements for the ethics and compliance reporting and case management processes and other aspects of the ethics and compliance program.
11. Assists with the ethics and compliance risk management and internal controls development process. Conducts risk and internal controls assessments of identified ethics and compliance risks. Recommends and implements internal controls improvements within the ethics and compliance function and in consultation with internal business partners.
12. Develops and delivers training and communications to managers and staff at all levels on reporting, case management and other aspects of the ethics and compliance program.
13. Participates in and supports ethics and compliance program on projects related to all elements of the comprehensive ethics and compliance program, including risk assessment, program assessment, third party compliance management, training and communications, enforcement and incentives, policy and procedure development, analytics, reporting and investigations.
14. Domestic U.S. travel may be required.
QUALIFICATIONS:
Graduate from an accredited college or university with a Bachelor's degree, preferably in ethics and compliance, law, criminal justice, or related field is required.
Five years of experience in ethics and compliance or in an assurance-related function is required.
Experience with risk management or managing an ethics and compliance hotline is preferred. Work experience should include relevant duties with highly confidential and sensitive issues. Government contracts compliance and corrections or law enforcement industry experience preferred.
Strong analytical, organizational, and written and verbal communication skills required.
Proficiency in Microsoft Office applications is required.
