Description:
Manages the processing of bankrupt loan accounts, including account level review of delinquent Chapter 7 Loans for letter notification, contact or collateral repossession as needed. Chapter 13 extension review and processing and monthly charge off recommendations. Represent the Credit Union's interests in member bankruptcy proceedings. Maintain working relationships with local counsel to file necessary court documents which protect the interest of the company and minimize risk. Audit bankruptcy files for compliance with federal and state regulations. Analyze trustee ledgers and payment histories. Perform final reconciliations as bankruptcy accounts are discharged, dismissed, etc. Manage bankruptcy processes as related to collateral document requests, assignments of mortgages, MERS, loan affidavits, etc. Monitoring deadlines for Proof of Claims and Objection to Plans. Review and reconcile fees and costs associated with the Proof of Claim and Post-Petition Fee Notice. File signed reaffirmation agreements with courts when necessary. Research servicing activities on legal matters and provide background research to Senior Leadership and internal counsel for any legal matters pertaining to default. Utilizes PACER to ensure any Bankruptcy issues are worked in a timely manner in compliance with all bankruptcy laws, the Fair Credit Reporting Act (FCRA) and other regulatory requirements. Serves as the liaison between Security Service FCU and any outside counsel retained to represent the Credit Union in any bankruptcy/legal matters. Additionally serves as the point of contact for any bankruptcy attorney/firm representing Credit Union members. Is the established subject matter expert, provides support and guidance to the enterprise groups to quickly identify technology and/or systemic problems relating to bankruptcy. Responsible for compliance and adherence to bankruptcy law by performing data quality and business process reviews; recommend corrective action, communication strategy, and training needs. Oversees all regulatory compliance of the bankruptcy process quality. Drives business process changes based on identified gaps or risks in existing tasks.
Bachelor's degree in a business-related field is required. Minimum 5 years' experience in the financial services industry. A minimum of 3 years primary experience working in Bankruptcy and/or Legal and PACER. In-depth knowledge of state and federal applicable to bankruptcy and a high degree of knowledge, background and training in TCPA, FCRA, CFPB, NCUA, FDCPA, legal requirements, mortgage default, collection and compliance. Strong analytical skills. Self-sufficient and self-motivated. Able to work independently or work in teams and collaborate with others to identify issues and solve problems.
