Performs a variety of professional legal, docket managementand supervisory functions to intake and prosecute felony offenses in the 18thJudicial District. Reviews, prepares, and tries criminal cases, providesrelated legal advice to law enforcement agencies. Performs related legal research andwriting. Work involves cases and dutiesrequiring an advanced level of experience and ability. Assumes responsibilities on behalf of theChief Deputy District Attorney (in conjunction with -or in the absence of- theChief Deputy). Participates in policylevel decisions regarding office functions. May prepare and present cases for grand jury. May lead teams as designated by the ChiefDeputy, Assistant District Attorney, or District Attorney.

Classification (level) and compensation is based on qualifications and experience as it relates to the position.
Deputy District Attorney - Organized Crime Unit: Generally, the hiring range is $95,000 to $123,500 annually
Senior Deputy District Attorney - Organized Crime Unit: Generally, the hiring range is $116,329 to $145,411 annually

ESSENTIAL DUTIES AND RESPONSIBILITIES: (The following essential job functions andexamples of duties are illustrative only and are not intended to be allinclusive; positions assigned to this class may not perform all of the dutieslisted.)

Prepares criminal matters for and represents the State in appeal and related hearings; may have primary responsibility in areasof felony case assignment. Screens criminal complaints brought the DistrictAttorney's attention by private citizens and/or law enforcement personnel.Assists the Chief Deputy, District Attorney or Assistant District Attorney inpreparing or trying criminal or quasi-criminal cases and in administrativematters, when so requested.

Interviews persons having pertinent information and conductsinvestigations to gather information necessary for criminal actions. Presentscases to and questions witnesses before the grand jury; prepares criminalindictments and subpoenas witnesses as directed by the grand jury.

Provides legal assistance and advice to law enforcementagencies in criminal matters; is available on-call at specified times for suchadvice and assistance. Acts as team lead of any designated team.

Reviews, prepares pleadings, and negotiates courtcases. Conducts legal research necessary for case preparation and or officemanagement to broaden legal background; keeps abreast of case law andlegislation affecting state criminal laws.

May present and advocate prosecution cases at trial; interviewswitnesses to ascertain their testimony; as applicable, conducts voir dire ofjury candidates and accepts or excuses jurors in light of perceived positionsrelevant to the victim, defendant, crime charged, and/or facts of the case;prepares and presents opening statement to provide finder of fact with overviewof case theory and supporting evidence; conducts direct and re-directexamination of prosecution witnesses to introduce physical and testimonialevidence to prove elements of crime(s) charged beyond a reasonable doubt withinnecessary foundations; offers objections to defense questions and statements toprotect witnesses from abuse and/or to prevent introduction of irrelevant orinadmissible evidence; advocates prosecution position in response to defenseobjections and/or court rulings to preserve an appellate record; conductscross-examination of defense witnesses to scrutinize and/or impeach theirtestimony; prepares jury instructions and advocates prosecution position tothe defense and court to negotiate finalversion; prepares and presents closing and rebuttal arguments to reviewevidence and advocate for conviction.

Researches and responds to a wide variety of defensemotions, e.g. suppression of statements/evidence, motions in limine, requestfor sanctions for violation of procedural rules, etc. Researches, prepares, and presents motions onbehalf of the people, e.g. amend charges, add charges, 404(b) similartransactions, child hearsay, motions in limine, etc. Researches, prepares, and presents briefs tothe Court advocating the People's position regarding legal issues raised duringmotions practice.

Acts in an on-call (after hours) capacity to respond topolice inquiries regarding search and seizure, probable cause to arrest,non-testimonial identification items, and related legal issues; reviewsaffidavits for probable cause for arrest and search warrants; contacts on-calljudge to arrange time for affiant to sign affidavit in judge's presence.

May respond to crime scenes as requested, to offersuggestions to police regarding scope of investigation and preservation ofevidence. Prepares correspondence ininstances where out of court communication requires documentation, e.g.advising defense of exculpatory evidence, requests to filing detective forfurther investigation.

Attends monthly training meetings; may prepare and presentlectures to attorneys on a variety of legal issues related to felonyprosecution. May make presentations toschools and community groups to explain the functional aspects of the legalsystem and/or current issues related to felony matters.

Performs other duties as assigned.

SUPERVISION RECEIVED: Works under the supervision of the Chief Deputy District Attorney, DepartmentHead, or under the general to broad supervision of other administrativesuperiors.

SUPERVISORY RESPONSIBILITIES: May assist with theorientation/training of newly assigned personnel and may supervise subordinatelawyers and other support staff in conjunction with -or in the place of- theChief Deputy.

INDEPENDENT JUDGMENT: Work in the class is accomplished through the application of legaltheory, applicable state statutes, and broadly defined case settlementguidelines to a variety of case facts and circumstances and requiresconsiderable legal and factual analysis on a diversity of issues

MINIMUM QUALIFICATIONS:

EDUCATION and/or EXPERIENCE:

Deputy District Attorney - Organized Crime Unit:
  • Graduation from law school as provided under Rule 205.1 ofthe Colorado Rules of Civil Procedure.
  • Licensed to practice law in the State of Colorado.
  • Attainment of an overall performance rating of "meets standard" or above as a county court attorney.
  • Attainment of a rating of "meets standard" or above in criteria established for promotion to district court

Senior Deputy District Attorney - Organized Crime Unit:
  • Graduation from law school as provided under Rule 205.1 of the Colorado Rules of Civil Procedure.
  • Five (5) years at the Deputy District Attorney - DistrictCourt level (or related equivalent governmental criminal prosecutionexperience).
  • A combination of experience and education may be considered.

KNOWLEDGE, SKILLS AND ABILITIES:

Considerable to extensive knowledge of the rules of criminalprocedure and the rules of evidence; ability to effectively apply same in apreliminary hearing/trial setting related to felony offenses. Considerableknowledge of state statutes and general knowledge of substantive case lawrelated to felony offenses. Ability to advocate and/or present legal/factualscenarios in a clear and persuasive manner to persons of highly varying legal,educational, and socio-economic backgrounds.

Ability to effectively process and dispose of felonycriminal case filings while maintaining a balance of equal justice betweenvictims, the People of the State of Colorado, and affected defendants; abilityto assess cases for strengths versus weaknesses and aggravators versus mitigatorsto determine just and ethicaldispositions that are within policies and guidelines promulgated by theDistrict Attorney.

Ability to react quickly and appropriately in court todefense objections, oral motions, court inquiries and rulings, and presentations/responsesfrom defense attorneys and witnesses. Ability to write in a succinct andwell-reasoned manner.

Ability to establish and maintain effective workingrelationships with superiors, co-workers, defense attorneys, victims, judges,court staff, police officers, witnesses, related agencies' personnel, and thegeneral public; ability to communicate effectively, both orally and in writing,with same.

CERTIFICATIONS, LICENSES, & REGISTRATIONS:

Licensed to practice law in the State of Colorado.Attainment of an overall satisfactory performance rating as county court anddistrict court attorney. Work in the class is accomplished through theapplication of legal theory, applicable state statutes, and broadly definedcase settlement guidelines to a variety of case facts and circumstances andrequires considerable legal and factual analysis on a diversity of issues. Understands the state requirements withrespect to victims' rights, pursuant to statute and applicable case law. This position requires successful completion of a criminal background check including fingerprinting through a national database.

WORK ENVIRONMENT: Work is generally confined to a standard office environment and requires no more than normal physical abilities.

In the event of an emergency/disaster in or near the County, all County employees are expected to make every effort to be available to assist the County Manager, Elected/Appointed Officials and Department Directors to ensure the continued operation of any and all necessary County functions. This may mean being available to perform additional duties and hours beyond what is normally required. In the event that an exempt employee does work more than 40 hours a week in support of County operations during an emergency, such employee may receive overtime or other appropriate wage compensation in accordance with existing County policies or at the discretion of the County.
