This position provides leadership in the organization or functional area and is primarily engaged in management activities that establish the direction of a department, function, or project. The position requires the application of knowledge gained from experience and expertise to the job duties and responsibilities. The position will make decisions in areas that may impact the organization and its employees, clients, budgets, policies, procedures, work practices, or compliance programs.

The purpose of this position is to perform the essential prime contract management job duties and functions as listed below with the overall objective of establishing an execution framework on the project that complies with the contract and ensures the safety, quality, value, timeliness, and Fluor profitability of the completed project.
Serve as subject matter expert in Prime Contract Management
Coordinate with the Law Department and Insurance and Risk Management Group to obtain and provide information regarding commercial issues as well as coordinate with Project Controls and Project Business Services on commercial issues
Lead effort to timely manage and administer the Prime Contract in conjunction with the Project Director and Law Department during the life of the contract; includes participating in proposal strategy sessions, prime contract review, joint venture and/or contract partnering, and risk assessment process prior to prime contract execution
Oversee the creation and review of formal project correspondence with clients and others to ensure Fluor's rights are protected and that it is consistent with the terms of the prime contract
Oversee disputed change management and claims resolution efforts
Support negotiations that lead to contract Change Orders / Variations
Maintain a long view of potential risk issues while developing strategies and tactics to mitigate risk
Facilitate smooth transition from Award to Execution with the support of the Project team throughout life of a risk project
Develop a complete understanding of Fluor prime contract and any relevant subcontracts
Read, understand, and administer the legal nuances and terms of the prime contract and assist project leadership so they do the same
Oversee the execution of the project in accordance with contractual obligations and Fluor's Operating System Requirements (OSR)
Ensure full compliance with Fluor prime contract with regard to client reporting, notifications, project system start up and close-out requirements
Monitor the establishment of the project baseline (as defined in the OSR), and ensure that it is fully documented, updated throughout all project phases, and appropriately communicated to Fluor project team
Assists in the delivery of the project in accordance with the project execution and commercial baselines
Understand the as-sold profitability target established in the project commercial baseline, and assist project in achieving the targets
Work with the Project Director to promptly prepare a contract summary and in conjunction with the Project Director communicate it to the project leads and update both the summary and understanding throughout the project as required
Monitor preparation of a written scope of facilities and services making sure they are consistent with the prime contract requirements
Review the Project Execution Plan (PEP) and Project Procedures Manual (PPM) for compliance with prime contract requirements, identify when changes to the PEP or PPM are required due to changes in the prime contract or changed conditions
Assist the Project Director in maintaining effective client relations that result in active cooperation, prompt payment, and the desire to award follow-on work
Assist the Project Director in establishing, maintaining and managing a fully documented change management system that tracks all changes to the prime contract and project baseline requirements or conditions and is consistent with the change management provisions of the prime contract
Assist the Project Director in following the Disputes process as defined by the prime contract to track and administer throughout the project, in close coordination with the Law Department
Participate in establishing and updating the Fluor Business Risk Management Framework (BRMF) throughout the project life-cycle, this includes participating in the initial and quarterly project BRMF assessments, coordinate the project BRMF results with Fluor financial reporting and review and implement risk mitigation strategies consistent with the prime contract provisions
Assist the Project Director in the review of project invoices so they are submitted to the client in accordance with prime contract requirements and proactively follow up on accounts receivable and the timely receipt of payment in order to minimize the cost and provide notice to the client of any delinquent payment consistent with the prime contract requirements
Keep supervisor and functional leader informed on project status, including client relations, project cost and schedule, changes in risk assessment, anticipated changes in project financial performance, and any other major concerns
Participate in functional management team reviews
Provide contract reviews/audits to projects to identify potential contract problems and process improvement opportunities
Ensure compliance with management of vital records and relevant correspondence to support reporting, contract audit, claims and litigations, and contract close out
Track Prime Contract Notice Requirements, give timely notice, and initiate actions required to
follow-up when required
Assist the Project Director in the area of project records so that they are identified, collected, indexed, filed, stored, and maintained (including supplier records) in accordance with the project file index, retention schedule and any prime contract specified requirements
Review, organize, and share relevant lessons learned from other projects and seek advice from other experienced managers as necessary throughout the life of the project in the area of prime contract management
Maintain compliance with all applicable policies, procedures, and global standards
Adhere to and support Fluor's Health, Safety & Environmental and Sustainability Policies
Effectively develop and apply the Core Skills to the job
Travel to attend to business related matters, as needed
Meet expectations on attendance and punctuality
Other duties as assigned

Basic Job Requirements
Accredited four (4) year degree or global equivalent in applicable field of study and twenty (20) years of work-related experience or a combination of education and directly related experience equal to twenty-four (24) years if non-degreed; some locations may have additional or different qualifications in order to comply with local requirements
Ability to communicate effectively with audiences that include but are not limited to management, coworkers, clients, suppliers, contractors, and other stakeholders
Job related technical knowledge necessary to complete the job
Ability to learn and apply knowledge of applicable local, state/province, and federal/national
statutes and regulations
Ability to attend to detail and work in a time-conscious and time-effective manner

Preferred Qualifications
Accredited degree (or global equivalent) in business, law, engineering, construction
management or cost engineering or equivalent experience
Advanced degree or certification in Construction Law / Contract Management profession a plus
Minimum of eight (8) years of relevant experience in engineering, procurement, fabrication, and
construction/construction management (EPFC/CM) project management /contract management
Project or area management experience in a multinational business environment and diverse
cultural environments is recommended
Demonstration of successful performance as project manager on a minimum of two (2) medium
to large sized projects or multiple project assignments in a significant role on large to very large
sized EPFC/CM projects is recommended
Completion of all required in-house project management courses in addition to courses
obtained from university or other qualified sources
Requires a comprehensive knowledge of industry business practices and management of
contracts, subcontracts and the procurement process
Experience in contracts law, contract drafting, administration and negotiation of change orders,
pricing of changes and delays, planning, and scheduling
Proficiency in the formation, management and administration of prime contracts
Strong written and oral communication skills, excellent interpersonal skills
Strong negotiation and issue resolution skills
Strong relationship and team building skills
Strong training, mentoring, and facilitation skills
Strong critical thinking skills
Good knowledge and experience on project design, engineering, procurement, material management, construction, commissioning, start up, turn over work processes, sequencing, and interfaces, is recommended
Project Controls and Finance knowledge is recommended, including understanding of:
o Scheduling (including manpower loading)
o Progress measurement
o Risk assessment and management
o Code of accounts
o Work breakdown structure
o Change management
o Cost control
o Estimating process and planning
o Global Pricing Model (GPM), Project Status Review (PSR) and Project Margin Analysis Report (PMAR) development and reporting
General understanding of contract law and when to engage the Law Department
Understanding of regulatory requirements including permitting

Other Job Requirements
Provide ongoing training in the various aspects of prime contract management to project managers and to other key members of project teams to address prime contract management principles, subcontract formation and administration, identification, preparation and resolution of claims
Work with Construction, Engineering, Supply Chain Management, the Law Department, and Insurance and Risk Management to assist in facilitating organizational interfaces between those performing subcontract formation and administration
Ensure compliance to applicable Fluor Practices
Maintain knowledge bank of Fluor Prime Contract Management Practices
Provide specialized trouble-shooting to projects
Participate in Fluor University
Utilize Knowledge Management processes to capture, support, and leverage relevant knowledge to enhance project execution
Participate in sales and marketing efforts
