Overview

    The Senior Attorney will be responsible for handling litigation, labor & employment, and compliance with the Legal team for McDermott's CB&I(r) Storage Solutions (CB&I) business. This position is an individual contributor role requiring advanced knowledge in CB&I Storage Solutions markets, products, clients, and customers. The role directly reports to the Director of Legal for CB&I.

Responsibilities

  • Provide legal input into proposals / ITB's, oversee the preparation of contract deviations, and manage negotiations for new opportunities (which includes review of EPC Contract terms and conditions, pricing/payment schedules, scope of work, project procedures and execution schedules on lump sum, unit rate and reimbursable contract models) in the US, Canada, and the Middle East (Dubai, Saudi, Qatar, Kuwait and Oman).
  • Prepare and negotiate change orders, extensions of time and claims raised by clients, vendors, subcontractors, and CB&I.
  • Advise, review and negotiate EPC project-related MOU, Consortium, Joint Venture, Partnership and Shareholder Agreements.
  • Ensure project contracts are consistent with the McDermott project objectives and McDermott policies whilst avoiding onerous liabilities.
  • Advise on and review of financial instruments (e.g., letters of credit, bank guarantees) and project finance matters with Finance.
  • Coordinate with Tax Department on contract structure based on applicable tax matters arising out of the execution of projects.
  • Participate in management review meetings.
  • Review and approve subcontracts and purchase orders for projects in coordination with the Subcontracting & Procurement Department.
  • Review and negotiate Secrecy Agreements and Interoffice Agreements.
  • Advise on and review parent company guarantees.
  • Advise on corporate house-keeping matters such as delegations of authority and powers of attorney.
  • Partner with Operations, Commercial Management, Human Resources, Sales, Internal Audit, Supply Chain and other functions to implement procedures and processes to mitigate risk and avoid litigation.


Qualifications

  • Juris Doctorate or equivalent
  • 7+ years industry experience is required with specific experience in construction litigation, labor & employment, and compliance matters.
  • Proficient in English is necessary
  • Ability to manage heavy workload in a high-pressure environment
  • Experience and understanding of international anti-corruption and global trade compliance laws and regulations
  • Must exhibit strong analytical and problem-solving skills with reliable judgment
  • Must possess exceptional written and oral communication skills
