The Office of Superintendent of Insurance (OSI) is New Mexico' s agency for oversight and regulation of insurance. OSI oversees private health and life insurance, auto insurance, business insurance, home insurance, and title insurance. We review premium rates and other plan details to ensure insurance is reliable, the company is financially solvent, and rates are fair and reasonable. We also oversee producers (formerly known as brokers and agents) who sell insurance in New Mexico.
This position may be located either in Santa Fe or Albuquerque.

Why does the job exist?
The purpose of the position is to provide direct legal services to the Office of Superintendent of Insurance's Divisions and Bureaus by providing quality legal advice, representation, and advocacy for the Bureaus and programs in administrative hearing involving compliance and enforcement actions and in litigation before state court and federal courts. The position also performs timely and thorough legal review of public records requests and responses. Other duties could include providing legal advice to assigned Bureaus, drafting insurance related administrative rules, conducting legal research, and preparing opinions and recommendations. This job description is intended to describe the general nature and level of work being performed by the employee assigned to this position. All personnel may be required to perform duties outside of their normal assigned duties.
How does it get done?
- Review, evaluate, and prosecute requests for enforcement action.
- Draft documents that are required for regulatory and compliance matters, including letters, notices of violation, and orders to show cause.
- Provide legal representation in judicial proceedings in state court and federal courts; and perform timely and thorough legal review of public records requests and responses.
- Provide legal advice to assigned Bureaus.

Ideal Candidate
* Prior regulatory, litigation, either civil or criminal and administrative law experience;
* Ability to work independently with minimal supervision;
Excellent oral and writing skills;
Prior criminal or civil prosecution experience;
Self-starter; and
* Team player.
Minimum Qualification
Juris Doctorate degree from an accredited school of law. Must be licensed as an attorney by the Supreme Court of New Mexico or qualified to apply for limited practice license (Rules 15-301.1 and 15-301.2 NMRA). Employment Requirements
All Attorney classifications must be and remain licensed as an attorney, in good standing, by the Supreme Court of New Mexico, or licensed as an attorney and in good standing by the highest court of another state and eligible pursuant to the limited license provisions (See Rules 15-301.1 and 15-301.2 NMRA).
Must possess a valid New Mexico Driver's license, a current defensive driving course certification from the State of New Mexico or must pass Defensive Driving Course Certificate within six months of the date of hire as a condition of continued employment.
Working Conditions
Work is performed in an office setting: late hours, weekends, on-call and callback work may be required. Will be exposed to regular periods of video display terminal and keyboard usage and stressful situations. Travel is required. Possible exposure to irate clientele. Incumbent will work under stress and frequent time constraints.
