Job Summary:

Responsible for handling legal matters related to labor and employment laws, physician and advanced practice provider contracting, and physician compensation. Works with a high degree of autonomy to manage EPLI claims, draft physician and advanced practice provider contracts, oversee physician compensation compliance and handle day to day counsel on labor or employment issues for the system consistent with the FTCH mission, vision, and enterprise values.

Additional Job Responsibilities:

  • Provides counsel to the system on employment law matters including, but not limited to: fair employment, wage and hour, employee safety, hiring, performance management and termination, restrictive covenants, reductions in force, state and federal leave laws, ADA accommodations, arrest and convictions, caregiver background laws, employee privacy, affirmative action, drug and alcohol policies, and employee personnel records.
  • Provides counsel on labor matters pertaining to both the unionized and non-unionized workforce. Oversees union contract negotiations.
  • Investigates EEOC/ERD claims and drafts position statements.
  • Drafts and/or reviews employment policies in collaboration with human resources.
  • Manages outside counsel engaged to defend complex employment law claims, including class action suits to ensure a cost effective and sound resolution.
  • Delivers legal updates and/or training to leadership on employment related issues, including significant changes in laws.
  • Stays up-to-date with changes to legislation, particularly in relation to laws, rules and regulations that directly affect the health care industry, labor and employment laws, and physician contracting trends, including restrictive covenant laws.
  • Drafts physician and advanced practice provider employment agreements, amendments, and termination notices. Creates and periodically updates template employment agreements.
  • Reviews physician compensation arrangements to ensure that they are compliant with policies and laws such as the Stark Law and Anti-Kickback Statute. Provides legal counsel on physician compensation plans.


EXPERIENCE DESCRIPTION:

Must have a minimum of 3-8 years of relevant labor and employment experience in an in-house or law firm setting, a hospital or healthcare setting, preferred. Experience in physician compensation preferred.

EDUCATION DESCRIPTION:

Juris Doctorate (JD) from an accredited law school required.

SPECIAL SKILLS DESCRIPTION:

Excellent oral and writing communication and interpersonal skills. Excellent legal research, with a strong attention to detail. Ability to work independently and as part of a team. Demonstrated ability to manage a range of legal matters. Ability to translate complex legal concepts into actionable advice for the business teams. Self-starter capable of working independently and seeking direction as needed. Ability to work in a demanding environment, prioritize responsibilities, and meet deadlines will be necessary. Proficiency in legal software and Microsoft Office Suite. Commitment, value, excellence, and professional development.

LICENSURE DESCRIPTION:

Licensed to practice law as in-house counsel and in good standing in the State of Wisconsin or be eligible to seek admission to practice in Wisconsin upon hire.
