Definition and Distinguishing Characteristics
It is intended that the successful candidate for this position will be assigned primarily to represent Child Protective Services (CPS), providing advisory and litigation services in connection with dependency proceedings, including appeals. The successful candidate will receive other assignments based upon the experience and interests of the candidate, and the needs of the office.

DEFINITION

Deputy County Counsel II

Under general direction, to perform complex legal work in the interpretation and application of law for the County of Amador and its various subdivisions; to perform legal research and represent the County in assigned legal proceedings and transactions; and to do related work as required.

Deputy County Counsel III

Under general direction, to perform the more difficult and complex professional legal work in the interpretation and application of laws for the County of Amador and its various departments and subdivisions; to perform legal research and represent the County as a member of the County Counsel's Office in assigned legal proceedings and transactions; and to do related work as required.
DISTINGUISHING CHARACTERISTICS

Deputy County Counsel II

This is the experienced journey level in the County Counsel office. Incumbents are typically assigned a wide range of civil litigation including court and administrative trials and other matters. They are expected to complete legal assignments with minimal assistance.

Deputy County Counsel III

This is the advanced journey level in the Deputy County Counsel class series. Incumbents are assigned the more difficult and complex civil matters and cases, as well as the full scope of legal assignments performed by the County Counsel's Office. They are expected to complete legal assignments with minimal guidance and assistance.

Examples of Duties
The following are the duties performed by employees in this classification. However, employees may perform other related duties at an equivalent level. Each individual in the classification does not necessarily perform all the duties listed.
Deputy County Counsel II
  • Confers with, and advises County Departments on routine legal questions
  • Drafts ordinances, contracts, leases, and resolutions, and other legal measures, submitting them to other Department legal staff for review and discussion
  • Develops recommendations concerning the advisability to prosecute, compromise, or dismiss civil litigation
  • Discusses cases with other legal staff; performs legal research
  • May prosecute and defend legal actions against the County and its subdivisions before all courts and various administrative bodies
  • May investigate claims and potential lawsuits
  • May be delegated to serve as legal counsel and attend meetings of boards and commissions
  • Dictates briefs and correspondence.
  • Serves as legal counsel for and attends meetings of various County boards and commissions
  • Performs detailed legal research into federal and state issues
  • Performs factual investigation into claims and actions
  • Prepares ordinances, resolutions, contracts, leases, deeds, and other legal instruments
  • Litigates on behalf of the County, including court and administrative trials in federal and state courts on trial and appellate levels
  • Advises County officers on legal issues relating to their County duties.

Deputy County Counsel III (in addition to above examples of duties):
  • Serves as legal counsel and attends meetings of boards and commissions
  • Performs the more difficult and complex legal research
  • Investigates claims and potential law suits
  • Drafts and edits ordinances, resolutions, contracts, leases, deeds, and other legal instruments
  • Prosecutes legal action on behalf of, and defends actions against, the County and its subdivisions before courts of origin, appellate courts, and various administrative bodies
  • Confers with and advises officers of County Departments and representatives of special districts on questions pertaining to their respective powers, duties, functions, and obligations
  • May have on-going responsibility for serving as legal advisor to a specific County Board or Commission such as LAFCO or the Planning Commission; prepares briefs and correspondence.

Essential Qualifications
Knowledge of:
Deputy County Counsel II:
  • California and federal statutes and cases and their application to governmental jurisdictions.
  • The principles of Civil, Constitutional, and Administrative Law.
  • Legal research methods.
  • California and federal statutes and cases and their application to governmental jurisdictions.
  • The principles of civil, constitutional, and administrative law.
  • Legal research methods including the use of computers/CD Rom.
  • Techniques of court and trial practice.

Deputy County Counsel III (in addition to Knowledge listed above):
  • Serves as legal counsel and attends meetings of boards and commissions
  • Performs the more difficult and complex legal research
  • Investigates claims and potential law suits
  • Drafts and edits ordinances, resolutions, contracts, leases, deeds, and other legal instruments

TYPICAL PHYSICAL REQUIREMENTS
Sit for extended periods; frequently stand and walk; normal manual dexterity and eye-hand coordination; corrected hearing and vision to normal range; verbal communication; use of office equipment including computers, telephones, calculators, copiers, and FAX.
TYPICAL WORKING CONDITIONS
Work is performed in an office and courtroom environment; continuous contact with staff and the public.

Training and Experience
Any combination of training which would likely provide the required knowledge and experience is qualifying. A typical way to obtain the required knowledge and abilities would be:
Education

Equivalent to possession of a Juris Doctorate degree from an accredited school of law.
Deputy County Counsel II

Three (3) years experience in practice of civil law involving (a) civil litigation or (b) at least three (3) years of work as a deputy county counsel, or assistant city attorney or in other public law practice.
Deputy County Counsel III

Three (3) years of experience in the practice of civil law comparable to that of a Deputy County Counsel II with the County of Amador.
SPECIAL REQUIREMENTS
Active membership in the State Bar of California.
