Why does the job exist?

The Compliance and Enforcement Section Chief oversees all inspections, Title V report reviews, compliance reporting databases and enforcement actions resulting from discovery of noncompliance for regulated sources of air pollution in the State. The Section consists of 2 compliance units and 1 enforcement unit. Through discovery of noncompliance and pursuit of enforcement actions, the Department aims to hold violators accountable, prevent recurrent violations and assure that violating regulations and permit conditions is not economically beneficial to the violator. The Section Chief reports directly to the Bureau Chief.

How does it get done?

- Employee supervision, including time approval, hiring actions, trainings, evaluations, disciplinary actions and ongoing feedback
- Conduct Section meetings and manager meetings to inform, train and stay updated on current activities within the Section
- Assist managers with project management - setting goals and objectives, milestones and timelines
- Work with the new Compliance and Enforcement (C&E) Section as needed to smooth employees' transition
- Manage operational activities of the C&E Section, this includes overseeing all three programs - Enforcement, Compliance Reports and Compliance Inspections. Implement policies and practices to ensure consistent application of civil penalties and enforcement actions
- Manage the Section's database and application needs, seeking upgrades or replacements to increase productivity and efficiency
- Work with Environmental Protection Agency (EPA) and the Inspections Manager regarding annual Compliance Monitoring Strategy
- Provide testimony at enforcement hearings as needed, with help from Office of the General Counsel (OGC), guide Enforcement unit on settlement strategy and on implementation of the current delegation order from the Cabinet Secretary
- Manage technical activities of the Section
- Review enforcement documents for technical sufficiency and consistency
- Assure adherence to EPA policies and guidelines and the Bureau's Civil Penalty Policy
- Write requests and responses to EPA and industry as needed to assure meeting requirements for compliance and enforcement
- Update protocols and Bureau policies as needed for efficiency, legal defensibility and in line with upper management's initiatives

- Occasional contact with external Federal, State and Local regulatory bodies as well as contractors and environmental not for profit organizations

Ideal Candidate

The ideal candidate will have experience in the following:
- Determining compliance status for environmental regulations, including air regulations and in issuing enforcement actions which include collecting a penalty
- Highly proficient at reviewing documents for technical sufficiency, consistency across cases, and clarity with a high level of detail required
- Significant program management and supervisory
- Facility with various databases and work flow/tracking applications also needed

Minimum Qualification

Bachelor's degree in Environmental Science, Animal Science, Natural Science, Biological Science, Physical Science and/or chemistry and eight (8) years of work experience in environmental science, animal science, natural sciences, biological science, physical science and/or chemistry. Any combination of education from an accredited college or university in a related field and/or direct experience in this occupation totaling twelve (12) years may substitute for the required education and experience.

Employment Requirements

Must possess and maintain a valid New Mexico Driver's License. Must possess and maintain a current Defensive Driving Course certificate from the State of New Mexico or must pass and receive a Defensive Driving Course certificate as a condition of continued employment.

Working Conditions

Work is conducted in an office setting with extensive computer and phone usage. Extended periods of sitting may be required. Up to 25% travel required to attend conferences or trainings, visit industrial sites of air pollution, and participate in settlement negotiations or hearings.
