The North Dakota Office of the Attorney General provides high-quality legal representation to over 70 state agencies, boards, and commissions, including the University System, the State Board of Higher Education, and various colleges and universities. The Civil Litigation Division handles a diverse range of legal matters, including social and health services, torts, civil rights, constitutional law, prisoner litigation, and labor law.
We are seeking an Assistant Attorney General to join our team and provide diligent advocacy and litigation support to state agencies and officials. This position will primarily assist in representing the Department of Health and Human Services (DHHS) in administrative proceedings related to both economic and non-economic programs. Responsibilities include defending Medicaid coverage decisions, pursuing Medicaid payment recovery, handling administrative child protection proceedings, overseeing daycare and foster care licensing matters, and representing DHHS staff in various legal proceedings. Additionally, this role offers the opportunity to engage in appellate advocacy, including arguing cases before the North Dakota Supreme Court.
Key Responsibilities:
Attorneys in the Civil Litigation Division have access to local, regional, and national training programs on topics such as advanced trial skills, depositions, appellate advocacy, e-discovery, and negotiations.

- Conduct case assessments and develop litigation strategies.
- Communicate with clients to provide legal guidance and case updates.
- Perform legal research, draft pleadings and motions, appear and argue motions before the administrative and district courts, and conduct discovery.
- Prepare for and appear for hearings including presenting evidence, examining witnesses, and presenting oral argument.
- Utilize secondary sources and expert consultations to strengthen case arguments.
- Manage case files, including filing documents, updating reports, and coordinating administrative support.

Minimum Qualifications
- Must be licensed to practice law in North Dakota or expect imminent admission to the North Dakota Bar.
- Strong ethical standards with a clean disciplinary record.

- Strong interpersonal skills to effectively collaborate with clients, colleagues, and the public.
- Sound judgment, reliability, and dedication to providing high-quality legal services to the State of North Dakota.
- Demonstrated ability to establish and maintain effective working relationships with clients, colleagues, and supervisors.
- Excellent time management and organizational skills.
- Proven legal research, writing, negotiation, and client advisory skills, or clear potential to develop these competencies.
