Brief Job Description:

The Director II works under the general direction of the LTCR Deputy Associate Commissioner for Licensing, Policy, and Training with considerable latitude for use of initiative and independent judgment. This position performs complex managerial work leading the day-to-day operations for the Policy and Rules Section. Responsibilities include interpreting state and federal laws and regulations and department rules and policy, as they apply to program strategic planning; rules and policy development; developing and implementing best practices; establishing quality assurance and performance measurement tools; developing and managing administrative and programmatic budgets; and ensuring effective utilization of resources. The Director is responsible for responses to inquiries related to policy and rules from all external entities, including providers. The Director actively coordinates, participates, and facilitates stakeholder meetings. The Director is a key employee in the LTCR legislative process including but not limited to being responsible for coordinating and completing bill analysis and providing testimony at hearings. The Director serves as backup to the LTCR Deputy Associate Commissioner of Licensing, Policy, and Training and completes other duties as assigned.

Essential Job Functions (EJFs):

Directs and manages the operations and activities of the Policy and Rules Unit. Directly supervises senior policy staff, managers and administrative staff. Develops and manages unit budget to ensure the proper and efficient use of available resources. Manages and develops unit staff through consultation, training and performance appraisal. Manages the workload to ensure the equitable distribution of assignments, the provision of adequate opportunities for cross training, the procurement of necessary resources to support staff, and the accurate, efficient and timely completion of assignments. Handles CAPPS responsibilities for total staff. Responsible for hiring and selection, assigning work, completing performance evaluations, recommending personnel disciplinary actions and scheduling and approving leave. 30%

Develops, implements, monitors and evaluates standards, policies and rules to support essential operations. Develops and oversees the development of rules, handbooks, policies and policy clarifications. 10%

Establishes working relationships, coordination and feedback processes to ensure that rules and policies take into account stakeholder input, and are consistent with HHSC rules, policies and initiatives. Serves as point of contact for federal, state and local agencies; consumer, advocacy and provider groups and organizations on rules and regulations involving regulated entities. Participates on task forces, committees and interagency workgroups as indicated. Works with advocates and providers to address issues related to the regulation of regulated entities. Participates in regular meetings with internal and external stakeholders. Analyzes statistical and operations data, interprets results, prepares reports and makes presentations to diverse groups. 20%

Prepares and presents proposed rule packets at meetings of the HHS Executive Council. Represents the department by developing presentations, providing information and testimony, collaborating with stakeholders, advocacy organizations, other state agencies and federal partners. 10%

Reviews and analyzes legislation related to regulated entities to include tracking legislative bills, prepares bill analysis, and provides testimony at hearings. 10%

Serves as resource for legislators, other elected officials, government entities and the general public. 10%

Establishes short-, mid-, and long-term unit goals and objectives and develops guidelines, procedures, policies, and rules related to regulated entities. Creates, implements and evaluates the unit strategic and business plans. Coordinates with all LTCR and other Regulatory Services and HHSC sections to ensure work plans and actions are consistent with the strategic direction for HHSC. 5%

Attends work on a regular and predictable schedule in accordance with agency leave policy and performs other duties as assigned. 5%

Knowledge, Skills and Abilities (KSAs):

Knowledge of local, state, and federal laws relating to regulation of facilities, agencies, and individuals providing care to people with disabilities and the elderly.

Knowledge of policies, procedures, and functions as they apply to regulatory activities.

Knowledge of public administration and management techniques.

Knowledge of program planning and implementation.

Knowledge of the functions of Long-term Care Regulation, preferred.

Skill in managing multiple and competing priorities.

Initial Screening Criteria:

Graduation from an accredited four-year college or university with major course work in a field relevant to the assignment is generally preferred. Experience and education may be substituted for one another.

Experience in the management of a business function, division, or department relevant to the assignment.

Experience with computers and software, such as MS Word, MS Excel, and MS PowerPoint.
