Description:
Responsible the administration and execution of the Banks Consumer Compliance monitoring and review program.
Responsibilities:
Minimum Education and/or Certifications Requirements:
Bachelor's Degree required. Bachelor's in business administration or liberal arts preferred. Certified Regulatory Compliance Manager (CRCM) certification desired or Audit related certification. OR 8-10 years of experience in regulatory compliance required in lieu of education.
Minimum Work Experience Requirements:
8 to 10 years of experience in Consumer Compliance required with a focus on reviews and/or audits. Same years of experience in compliance focused Internal Audit, Risk, Loan Review, or regulatory agency may also qualify.
Technical and/or Other Essential Knowledge:
Presentation, negotiation, and training skills. Knowledge of regulatory requirements that include deposits, loans and any other consumer compliance related regulations. General knowledge of statistical analysis. Excellent organizational, analytical and time management skills, as well as Auditing skills. Ability to interact with all levels of the corporate structure and members of the Consumer Compliance unit.
Responsibilities:
- Development and maintain comprehensive consumer compliance testing plans for consumer compliance reviews and monitoring and ensure alignment with regulatory requirements, policies and procedures, and risk assessments.
- Develop and maintain testing methodologies, including data analytics when applicable, to effectively evaluate adherence with compliance requirements and the design and effectiveness of internal controls.
- Annually, in coordination with the Consumer Compliance and CRA Manager, develop the annual review and monitoring plan taking into consideration risk assessments, review and monitoring results, audit results and regulatory exam results.
- Perform consumer compliance regulatory reviews based on the Annual Consumer Compliance Plan to detect violations of law and/or noncompliance with internal procedures.
- Maintain and document work papers, and issue formal reports to Management accordingly that include recommendations and corrective action as applicable.
- Monitor timely completion of action plans.
- Develop and maintain departmental procedures as applicable to the review and monitoring plan.
- Act as subject matter expert for new and existing laws and regulations to provide guidance and opinions to all levels of management and staff. Research and analyze laws and regulations. Prepare written and verbal opinions and communicate regulatory changes throughout the organization when applicable.
- As needed serve as a point of contact and liaison for compliance matters during exams by the Office of the Comptroller of the Currency, Federal Reserve, State of Florida, and internal audit. In addition to serving as a point of contact to any third-party consultants as needed.
- Ensure proper reporting of violations to duly authorized enforcement agencies as appropriate and/or required.
- Independently investigate and act on matters related to compliance, including the flexibility to design and coordinate internal investigations (e.g., responding to reports of problems, tips, or suspected violations) and any resulting corrective actions with all levels of management and staff and the vendors of the Bank when applicable.
- Assist in preparing reports to be presented to Consumer Compliance and CRA Committee.
- Develop, initiate, maintain and revise policies and procedures for the general operations of the Consumer Compliance program and its related activities to prevent illegal, unethical, or improper conduct and violations of law.
- Develop content and provide training sessions on regulatory compliance issues based on the Compliance Training Program to bank personnel, as needed, or required.
- Analyze existing policies and procedures in all relevant business units for gaps and opportunities to increase vigilance, monitoring, and reporting effectiveness. Works with business managers to enhance and improve policies and procedures to minimize losses for the bank.
- Identify, evaluate, monitor, and make any recommendation deemed necessary to Management to assess, reduce, eliminate, or control any current or prospective risks to earnings or capital arising from violations of, or nonconformance with, laws, regulations, prescribed practices, internal policies and procedures or ethical standards.
