Duties * Serves as a source of legal advice and counsel augmenting the AFOSI Judge Advocate Directorate's Associate Director, Information Law Division on the issues related to information maintained by the command, as regulated by the Freedom of Information Act (FOIA), and the Privacy Act, and will provide legal guidance and review regarding Congressional requests, inquiries, and actions, as well as media requests. * Criminal Law Attorney. The incumbent provides counsel within the areas of civilian criminal law that typically include: (1) extremely complex and difficult legal and factual questions that require a high order of original and creative endeavor to craft a reasonable balance between protecting the civil and privacy rights of United States persons with the need to conduct lawful investigative activities in furtherance of national-level, Department of Defense, and United States Air Force (Air Force) national security interests; and (2) novel and highly-technical questions in controversial and evolving areas of law affecting the national security of the United States, Department of Defense, and Air Force, including civil liberties; personal privacy; national security; military justice; readiness; civilian employee disciplinary matters; counterintelligence and the unique interests of law enforcement and the intelligence community, all of which are likely to set important precedents and can have the effect of substantially broadening or restricting investigative, intelligence, and force protection activities undertaken by the Department of Defense. * General Attorney (All Facets of AFOSI Mission). The incumbent provides counsel in the areas of federal employment law, ethics, fiscal and federal appropriations law, administrative law; counterintelligence law; intelligence law; cyber law; electronic surveillance; intercepts; complaints resolution; civil rights; Constitutional law; and any of the diverse legal issues that arise regarding AFOSI's mission. * Attorney-Advisor. The incumbent performs other duties as assigned, to include but not limited to, providing command-level advice and guidance on a full range of legal issues confronting law enforcement and intelligence agencies Requirements Conditions of Employment * U.S. Citizenship is required * If authorized, PCS will be paid IAW JTR and AF Regulations. All qualified candidates who meet the recruitment assessment criteria will be referred to the selecting official. * The incumbent must meet minimum training requirements set out in the Judge Advocate General's Corps policies * The incumbent must undergo an internal background investigation by AFOSI and must be approved for duty by the Commander of OSI or the Commander's designated representative(s) * Must be able to obtain and maintain a Top-Secret clearance with access to Sensitive Compartmented Information (SCI) * The incumbent may be required to work overtime * The incumbent may be required to travel by military or commercial transportations (e.g., airplane, automobile, subway, etc.) * Leave accrual may be authorized upon request * Advance in hire may be authorized if there is demonstrable proof on your resume Qualifications GENERAL REQUIREMENTS: * You MUST have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LLB or JD). * In addition, at the time of application, you must provide proof, dated within four months of application, of "active" status with a bar of the highest court of a State, U.S. commonwealth, U.S. territory, or the District of Columbia. On-line information is allowed as long as it shows that you are in "active" status. Specialized Experience: In addition to the basic requirement: you must have professional legal experience in excess of three (3) years that commensurate with the position's duties and responsibilities. KNOWLEDGE, SKILLS AND ABILITIES (KSAs): Your qualifications will be evaluated on the basis of your level of knowledge, skills, abilities and/or competencies in the following areas: 1. Must be a graduate of a law school accredited by the American Bar Association and be currently licensed as an attorney in active (or equivalent) status and in good standing with the bar of U.S. state, District of Columbia, territory, or commonwealth. Ability to independently prepare and present, both orally and in writing, relevant information required to process requests and to provide comprehensive legal opinions on issues related to criminal law, probable cause determinations, constitutional law, information law, general law, and OSI's full-spectrum investigative and counterintelligence mission. 2. Mastery of the professional field of information law, including Freedom of Information Act, the Privacy Act, the Federal Rules of Civil Procedure, the Federal Rules of Criminal Procedure, the Manual for Courts-Martial, Executive Orders, policies and opinions concerning the collection and dissemination of information of the Department of Justice, the Office of Management and Budget, DoD, the Air Force, and AFOSI, so as to be able to adapt and apply legal theories to routine as well as novel fact situations. Ability to independently write clear and comprehensive legal reviews, legal briefs, memoranda, instructional material, and other documents relevant to all aspects of the OSI mission and to present high-quality briefings, lectures, and speeches to high-level audiences on short notice. 3. Mastery of techniques and knowledge of various titles of law necessary to independently identify and analyze both issues of fact and issues of law with relation to information release (including but not limited to the Freedom of Information Act, the Privacy Act, inter- and intra-agency requests for information, discovery requests, media requests, and subpoenas), intelligence law, cyber law, military justice, search and seizure, criminal investigations, labor law, fiscal law, contract law, civil law, Constitutional law, and ethics. Ability to develop, train, and lead a focused intra- and inter-divisional team to address various legal issues and their application to AFOSI's national security and criminal investigations mission. 4. Mastery of the principles, concepts, and methods of legal research of various sources, such as statutes, executive orders, manuals, directives, issuances, computerized reference sources (i.e., Lexis and/or Westlaw), court decisions, administrative decisions, precedent case law, and commercial legal publications, sufficient to perform in-depth legal research into the legislative history, precedent case law, decisions, and opinions which bear on particular legal issues. 5. Knowledge, at a mastery level, of the professional fields of criminal law and litigation, including the ability to conform policy and practice to the confines of the law and regulations, and to apply this knowledge and develop strategies for unique and complex factual predicates in novel and time-sensitive situations. 6. Knowledge, at a mastery level and skill in fact finding, problem analysis, problem solving, and interpreting laws, directives, and policies, and the ability to apply that knowledge to make decisions or recommendations that may result in significantly changing, interpreting, or developing important public policies or programs. Knowledge of Department of Defense law enforcement and judicial systems and operation procedures, and the ability to work independently to identify issues relevant to the command's multiple mission areas. Additional Conditions of Employment: * This position has been designated by the Air Force as a Testing Designated Position (TDP) under the Air Force Civilian Drug Demand Reduction Program. Employee must pass initial and periodic short notice drug testing.
